Our stores have always carried BUTT Magazine, a lifestyle magazine that focuses on gay culture, art and fashion. But last week, a West Vancouver mother took offense to it after finding it in a display mannequin's backpack. Pulling it out of the display she wasn't allowed to touch, she thought the cover was "funny" and opened it up. When she saw the spread of art photographer Jeff Burton she began crying. She labeled it "pornography" and called every news station that she could think of. The store was fined $100 by the city.

We are very proud to carry BUTT in our stores and plan to appeal the fine. Photography of gay men is not automatically pornography and her assumption is offensive and dangerous. Free expression is under siege when sensitive

shoppers are the ruling authorities on what is or isn't porn. We'd like to leave that decision to the courts. This is not a question of morality but an issue of free expression and artistic taste.

Thankfully several great websites (these are a few: gayagenda, Tres Fab Sweetie) came to our support and the comments section on the CBC piece were fantastic. Almost everyone but the media was tolerant and understanding of the message we were trying to send. Take some time to show you know what's right by commenting here, or on other sites that have covered this story.

As always, you can find BUTT Magazine and the BUTT BOOK at American Apparel stores worldwide (properly merchandised to local law) or on our website.

Here are two statements we wanted to share:

STATEMENT FROM BUTT MAGAZINE, JANUARY 2009

Since its inception in 2001, BUTT magazine has been hailed for its groundbreaking and original approach to journalism. The tone of BUTT magazine is - as the title suggests - playful, sometimes ironic, and always positive and honest in its representation of gay life today and the equality of our times. From the beginning, the magazine has interviewed or commissioned such prominent figures as Michael Stipe of REM, writers such as Gore Vidal and Edmund White, fashion designer Marc Jacobs, Turner Prize winning artist Wolfgang Tillmans and film director Gus Van Sant.

In 2006 the respected art book publisher Taschen debuted BUTT BOOK, which has gone on to sell 50,000 copies worldwide. The magazine has a global circulation of 36,000, and is sold in high-end fashion boutiques, local corner newsstands, hip galleries and respectable cultural institutions worldwide. Retail locations include such respected institutions as the the Museum of Contemporary Art in Chicago, the New Museum in New York, MOCA in LA and the Walker Art Center in Minneapolis.

Besides American Apparel, the magazine's advertisers include leading brands such as Calvin Klein, Gucci, Adidas, Dior, Marc Jacobs, Helmut Lang, Yves Saint Laurent, all of whom have been supporting the magazine since its beginnings in 2001.

BUTT magazine is proud to work with a company like American Apparel that supports diversity and freedom of choice, and welcomes an honest and open discussion about sexuality in the real world today.

DOV CHARNEY'S LETTER TO HIS MOTHER ABOUT BUTT, FEB. 2007

Dear Mom:

BUTT is an important art magazine that I support. No question, that it is going to offend people and it is my feeling that that is the nature of provocative art. At times, to make progress, you end up offending people. And people were offended by many things I have done over the years. But I did what I felt was right, especially from an art and creative point of view.

We are going somewhere with what we are doing, and no one is required to buy it. Many people have told me how much they appreciate our carrying the magazine. It has sold out in some stores.

Also, because some moralistic anti-gay forces opposed our carrying it within our company, I am committed to having it. I wanted our company to be open enough to accommodate this kind of magazine, and if I don't set the precedent now, it could become too late to get that done later.

We are also facing customs obstacles in Asia which I am committed to overcoming, on civil libertarian grounds.

Sexual freedom, art, and photography are important to me and I am standing firm on my support for BUTT.

Dov

Butt is amazing!
It has been my boy bible for the past 7 years. They have the best writing, tone, and artwork. It is really so well done. Growing up in a strange town, I always think that I could have ended up a really bad homo if I hadn't had some good influences around me, and Butt was definitely one of them.
I work in an AA store and when customers ask if we have it, I am proud to be able to say "Yes! we do!"
I love AA for this.

It's classic "I'm a mother" syndrome. So scared of everything around here. Her daughter seeing a penis - or penetrative sex between men for that matter - is not going to change her world. In a year or two, that teenager will probably go out and experience these things on her own. By trying to "protect her" like this, her mother is creating a new generation of hypersensitive freak children who can't function in the world we actually live in.

Just go watch Jesus Camp. That's her daughter's future.

I find this completely ridiculous that this woman would complain to the media about an issue like this when there are far worse things on other magazines! What if it was a ELLE magazine with a man's ass staring at her face? Would that be pornographic? It's narrow minded people like this that we don't need in this world.Ridiculous

"When she saw the spread of art photographer Jeff Burton she began crying."

Step back and think for a minute. The woman "violating" a display and taking the magazine is wrong; that is theft and improper. AA is completely within its bounds to carry a magainze that it feels is relevant. It is also within the bounds of the woman to "alert the media" and even if she wants, to pickit outside in front of the store with a protesting sign. AA is well within its rights to carry potentially offensive material just as it is within this woman's right to protest and campaign against it. The minute we take away her "right" to do so, we remove AA's right to carry it. Freedom of speech works that way; when you truely embrace it, you accept the fact that someone may feel just as strongly against something that you feel strongly for; that is what it means to be an American. If you don't like it, then go somewhere else. Whether I agree with AA or the woman is irrelevant; each has the right, and the OBLIGATION, to share their views.

started CRYING?

can we ship these kinds of people, every so often, off to places of extreme poverty, political unrest, and AIDS to get them not only a heaping dose of reality, but also give them something to really shed tears about?

Why even open a magazine that is called 'BUTT' when it has a picture of a barely dressed man on the cover If you are the type of person who will cry at images of, well, BUTTs!

BUTT and AA are perfect together. Both are honest, forward-thinking, stylish and provocative. I hope there is no question that AA will stop selling this. Its what makes AA stand apart from other high street fashion retailers, promoting itself as a unique brand with an understanding of its customers.

Shame on that 'mother'. She should have gone to GAP if she wanted a generic brand with no imagination.

Good point Marc! Thanks for putting "free expression" into perspective.

(Though there is a difference between citizens picketing and the government issuing a fine.)

working for the store now for approx. 1 1/2 yrs, i have come to love incidents such as this. i love when people get a chance to thoroughly form opinions. let's take a minute and thank this woman for basically having a mild heart attack over the BUTT book, because we all get to express how we feel about it. personally, i like that i got to laugh and tell people how crazy she is. i also got a nice reminder of how awesome and supportive my own mother is when it comes to controversial issues. so keep these sorts of things coming, it's what makes the world of interest. and not only that, but i feel really good about myself for being so sensible and open minded! thank you outrageous, overreactive people :)

Court rulings like this are worse than annoying they are socially damaging. The more reactionary elements of the media will always chase the latest hysteria to push sales and encourage conservative thinking not realizing that ultimately restriction on free speech can eventually be turned on them. Moral panics like this are often picked up on by weaker politicians looking for a quick means to raise their profile and boost their support instead and distract attention from real problems such as mismanaging of the economy and disparagy of wealth. An independent judiciary should stop such attacks on fundamental rights such as free speech but when you've got heads of state on your ass followed by a mob of idiots and trumpeted by the media mouth piece no wonder courts bow down and force such rulings.

Nobody forces anyone into the store, to buy any of the publications, to then sit down and read them. This lady is quite clearly looking for something to be upset about and it is people looking for trouble who create the problems. However, as things have gone so far she cannot simply be ignored and people should stand up and say that they want a diverse and pluralized society and they will not have culture restricted to the limits of the mentality of the ignorant.

wait, gay people are into FASHION?? what kind of perverted world are you people are living in???

the only crime here is if AA didn't have any kleenex on hand for this cracked princess

Wow that's so sad! ! It's clear she has a problem with homosexuality not sexuality in magazine and that is a huge problem. I wonder when she walks into 7-11,a " corner" store, or any large Grocery store does she snatch Maxim magazine down because it "objectifies" women?I find it hillarious that it's okay to see a girls tits and half her ass in a store that sells food, but in a store that has fashion ( which is art) art can't be sold!

If you don't like it then leave or close your eyes. Just because you disagree doesn't mean your ideals should be pressed upon thousands of others who actually enjoy it. I'm happy AA stood up to this. bravo :)

I wonder if she cries at the sight of her own Butt.
